Terms of Service

Last updated: October 1, 2026

1. Acceptance of Terms

By creating an account on Tumaro or using any part of our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Tumaro LLC, a California limited liability company. Acceptance is recorded when you affirmatively agree during onboarding or checkout. You must be at least 18 and legally able to contract. A business signer represents that they are authorized to bind that business.

2. Description of Service

Tumaro is a marketplace platform that connects customers with independent mobile detailing service providers ("Providers" or "Detailers"). Tumaro provides the technology platform to facilitate bookings, payments, and communication between customers and Providers.

Tumaro does NOT perform detailing services. We are a technology platform only. All detailing services are performed by independent Providers who use our platform.

Tumaro is not a detailing company, a service provider, an agent of any Provider, an employer of any Provider, or a party to any service contract between you and a Provider. Any contract for detailing services is solely between the customer and the Provider. Tumaro's role is limited to providing the technology that allows you to discover, book, communicate with, pay, and review independent Providers.

3. User Accounts

  • You must provide accurate, current, and complete information when creating your account.
  • You are limited to one account per person. Creating multiple accounts may result in suspension or termination of all accounts.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Provider Status

Providers (Detailers) on the Tumaro platform are independent contractors. They are NOT employees, agents, or representatives of Tumaro. Tumaro does not control, direct, or supervise the manner in which Providers perform their services.

Providers are solely responsible for their own business operations, including but not limited to insurance, licensing, tax obligations, and the quality of services they deliver.

Insurance and Public Listing. A Provider may create and configure a Tumaro profile before submitting insurance. However, the Provider will not be displayed on Tumaro's customer-facing homepage, map, search, public business pages, or agent discovery tools, and cannot receive customer bookings, until Tumaro has accepted a current proof-of-insurance document. If the accepted policy expires or is revoked, public listing and new bookings are paused until a new current document is accepted.

Limited Screening and Verification. Tumaro may collect and review identity, payment-onboarding, licensing, or insurance information and may display related status indicators. These reviews are limited, may rely on documents or information supplied by Users or third-party services, and do not constitute a guarantee that information is current, authentic, complete, or adequate for a particular service. Unless expressly stated, Tumaro does not conduct criminal background checks, drug testing, vehicle inspections, or independent professional verification of every User submission. Tumaro does not endorse any Provider. Your decision to engage with a Provider or customer remains your own, and you should use reasonable judgment before an in-person service.

Assumption of Risk. Mobile detailing involves the use of water, chemicals, tools, and physical work on or near your property. By booking a service, you acknowledge that there are inherent risks involved, and that the Provider — not Tumaro — is the party responsible for the safe and competent performance of the service.

5. Booking and Payment Terms

  • Tumaro charges a 5% platform fee on the service subtotal. Consumer prices include mandatory platform and processing charges. The checkout itemizes these included charges; optional extras and tips change the total you authorize. Providers set their own service rates; Tumaro sets its platform charges.
  • All payments are processed securely through Stripe, Inc. By making a payment, you agree to Stripe's terms of service.
  • Tips are optional and go 100% to the Provider. Tumaro does not take any portion of tips.
  • Provider payouts normally become eligible after customer confirmation or automatic confirmation 48 hours after completion, subject to disputes, payment settlement, and payout-account requirements. Stripe and banks determine when released funds reach a bank account; instant or same-day arrival is not guaranteed.
  • Prices are set by individual Providers. Tumaro does not set or control service pricing.

6. Cancellation and Refund Policy

Cancellation fees are based on how far in advance the booking is cancelled:

Cancellation WindowFee
4 hours or more before service0% (free cancellation)
Within 4 hours of service50% of service price

If a Provider cancels a booking, the customer receives a full refund of the amount charged, including mandatory fees and tip. Late customer-cancellation charges apply only to the discounted service and add-on subtotal, not to tips or mandatory fees. See the Refund Policy for no-show and dispute rules. Statutory remedies are preserved.

For full details, see our Refund Policy.

7. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, Tumaro expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from a course of dealing or usage of trade.

Tumaro makes no warranty or representation regarding the quality, safety, legality, qualifications, or availability of any Provider or detailing service offered through the platform, the accuracy or reliability of any listing, review, rating, or communication, or the conduct of any User of the Service whether online or offline.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUMARO IS NOT LIABLE FOR:

  • Vehicle damage — Any damage to vehicles that occurs during or as a result of services performed by Providers.
  • Service quality — The quality, completeness, or timeliness of services performed by Providers.
  • Disputes between users — Any disputes, claims, or disagreements between customers and Providers.
  • Provider actions or omissions — Any actions, errors, negligence, or misconduct by Providers.
  • Indirect or consequential damages — Including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Tumaro's total aggregate liability to you for any claims arising from your use of the Service shall not exceed the greater of $100 or the platform fees you paid to Tumaro in the twelve (12) months preceding the event, solely to the extent this limitation is lawful.

Nothing in these Terms excludes liability for Tumaro's fraud, willful misconduct, gross negligence, or any obligation or remedy that cannot lawfully be limited. These limitations do not reduce refunds owed under the Refund Policy, amounts owed to Providers, or nonwaivable consumer rights. A marketplace description does not excuse Tumaro from its own legal duties.

8. Responsibility for Third-Party Claims

To the extent permitted by law, you are responsible for third-party claims caused by your unlawful conduct, infringement of another person's rights, or material breach of these Terms. This does not require you to indemnify Tumaro for its own negligence, misconduct, or legal violations. Tumaro will provide prompt notice and reasonable cooperation; no settlement may impose an admission or nonmonetary obligation on you without your consent. Consumer rights that cannot be waived remain protected.

9. Dispute Resolution

Arbitration notice: Except for the exceptions below, you and Tumaro agree to resolve disputes arising from these Terms or the Service through individual binding arbitration instead of a court or jury trial. First contact support@tumaro.app to attempt informal resolution for 30 days. This process does not prevent urgent relief, a regulator complaint, or filing needed to preserve a limitation period.

Arbitration is administered by the American Arbitration Association under its applicable rules. Consumer disputes use its Consumer Arbitration Rules and applicable fee schedule; work-related or business disputes use the rules AAA determines applicable. Rules are available at adr.org. Tumaro pays costs allocated to the business and any additional costs required by law. Hearings must be reasonably accessible, including remote participation where available. The arbitrator may award all relief available under applicable law.

Either party may bring an eligible individual claim in small claims court. Nothing waives public injunctive relief in any available forum, regulator access, or claims that applicable law excludes from mandatory arbitration. A court decides whether an arbitration agreement was formed and whether this provision is enforceable. If AAA cannot administer because of Tumaro's failure to comply with its rules, the claimant may pursue the dispute in court.

To the extent lawful, arbitrated claims proceed individually, not as class or consolidated proceedings, unless both parties agree otherwise. This does not waive nonwaivable representative remedies. An unenforceable restriction on relief is severed; that relief may be pursued in a court with jurisdiction. If the individual-arbitration requirement cannot lawfully apply to a claim, that claim proceeds in court rather than class arbitration.

You may opt out of arbitration within 30 days after first accepting this version by emailing support@tumaro.app with your name, account or booking identifier, and a clear request to opt out. Opting out does not affect use of the Service. Ordinary statutory filing deadlines apply; these Terms do not impose a one-year deadline. Changes apply prospectively after affirmative acceptance and do not retroactively change the agreement governing an existing dispute.

10. User Responsibilities

  • Provide accurate and up-to-date account information
  • Make timely payments for services received
  • Be present (or have a representative present) at the service location during the scheduled service
  • Treat all users of the platform with respect and professionalism
  • Not use the Service for any illegal or unauthorized purpose
  • Not interfere with or disrupt the Service or its infrastructure
  • Not attempt to circumvent the platform to avoid fees

11. Account Suspension and Termination

Tumaro reserves the right to suspend or terminate your account at any time, with or without notice, for reasons including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Abusive behavior toward other users or Tumaro staff
  • Repeated no-shows or cancellations
  • Circumventing platform fees or payment systems

Upon termination, your right to use the Service will immediately cease. Any outstanding payments or obligations will survive termination.

12. Intellectual Property

The Tumaro name, logo, branding, website design, software, and all associated content are the proprietary property of Tumaro and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or its content without prior written permission.

User Photos, Reviews, and Other Content

You retain ownership of content you upload. You represent that you own it or have permission to upload it and authorize its intended display, including permission from identifiable people where required. Do not upload stolen images, confidential information about others, illegal content, or deceptive reviews.

You grant Tumaro a nonexclusive, royalty-free license to host, reproduce, resize, and display your content as needed to operate the Service and provide the features you choose. Profile, gallery, and review content is public; messages and service/dispute evidence are restricted to authorized recipients and support. This license does not authorize unrelated advertising use of private evidence. It ends on removal except for lawful retention, backups, and copies already shared as part of the Service.

Report illegal, infringing, defamatory, or privacy-violating content to support@tumaro.app with its URL or booking reference, your contact details, and the reason. Tumaro may restrict access while investigating and may remove content or suspend repeat infringers. Copyright notices should identify the protected work and disputed material, include contact information, a good-faith statement, an accuracy/authority statement under penalty of perjury, and a signature. Tumaro does not claim that a takedown email alone establishes statutory safe-harbor eligibility.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By accepting these Terms, you acknowledge the Privacy Policy. Separate opt-ins are requested where required; acceptance does not waive privacy rights.

14. SMS / Text Message Program

If you voluntarily check the SMS consent box and submit the applicable form (during account setup, in your account settings, or when booking as a guest), you agree to receive recurring automated transactional text messages from Tumaro related to your bookings and use of the Service, including booking-request confirmations, booking confirmations, appointment reminders, detailer en-route updates, arrival notifications, completion notifications, and customer-support communications.

  • Consent is not a condition of purchase. You can use the Service and book washes without opting into text messages.
  • Message frequency varies based on your booking activity and may include up to 5 messages per booking.
  • Message and data rates may apply, depending on your mobile carrier plan.
  • You can opt out at any time by replying STOP to any message. After opting out you may receive one final message confirming that your opt-out was processed. Reply HELP for help, or contact us at support@tumaro.app or the phone number listed in the footer of this page.
  • Carriers are not liable for delayed or undelivered messages.
  • You are responsible for providing a valid mobile number and for notifying Tumaro (by updating your account settings or contacting support) if your number changes.
  • Tumaro may modify or discontinue the messaging program, subject to applicable law.

How we handle the mobile information you provide for this program is described in our Privacy Policy.

15. Modifications to Terms

Tumaro reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you via email or an in-app notification.

Material changes require affirmative acceptance before new bookings or other gated transactions. You may still access support and exercise existing rights. Prior versions remain available in our records for transactions governed by them. Unenforceable provisions are severed to the extent lawful without eliminating nonwaivable remedies.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the courts located in the State of California.
